Now that the Obama Administration has granted any individual who desires to opt out of Obamacare an exemption, it is tough to see how the Federal Government will be able to enforce the Person Insurance Necessity mandated by the “Affordable” Care Act. The latest exemption to the Person Mandate to have insurance is that anyone who has a “hardship” is exempted from paying out a tax/penalty for not getting insurance coverage. The “hardship” can be cited without having even getting documentation of this kind of “hardship.”

As the personal mandate looms on March 31, 2014, the most significant mass civil disobedience in American Background could be taking area. If a single can claim anything to include the expense of Obamacare/ACA itself to be a “hardship” why would anyone choose to sign up for Obamacare or decide on to pay a tax or penalty?

It is unclear how aggressive the government will be in enforcing the requirement to have insurance coverage and in collecting the penalty. If a customer fails to pay out the penalty at tax time, the Inner Revenue Services can deduct it from any refund owed the taxpayer, but it can not impose a lien on property or garnish wages. Underneath the health care law, the customer “shall not be subject to any criminal prosecution” for the failure.

If any individual can pick to declare anything as a “hardship” and not indicator up for Obamacare and the ACA law itself limits repercussions to non-issues, why would any individual indicator up or shell out a penalty?
